POLÍTICAS PÚBLICAS DE FORTALECIMENTO DOS DIREITOS FUNDAMENTAIS DOS INDÍGENAS: EXPERIÊNCIA NEOZELANDESA / PUBLIC POLICIES OF STRENGTHENING THE FUNDAMENTAL RIGHTS OF INDIGENOUS PEOPLE: NEW ZEALAND EXPERIENCE
Abstract
A consolidação de um Estado Democrático exige não apenas o reconhecimento da sua diversidade, mas também a implementação de políticas públicas capazes de garantir a eficácia social dos direitos fundamentais das minorias que o compõem. Nesse contexto, o presente trabalho visou apresentar as políticas públicas que vêm sendo exitosamente implementadas na Nova Zelândia para a proteção e a promoção dos direitos dos indígenas Maoris. Para tal, foi realizada pesquisa bibliográfica e documental na doutrina e na legislação neozelandesa. Objetivou-se, assim, contribuir para o aperfeiçoamento do sistema jurídico brasileiro, haja vista o direito comparado constituir fonte valiosa de conhecimento, capaz de oferecer alternativas para a solução dos problemas que o Estado Democrático de Direito brasileiro deve enfrentar para garantir a efetividade dos direitos fundamentais de todos os seus cidadãos.
