The evolutionary interpretation in the framework of the Inter-american System of Human Rights

Based on national and foreign references, this research has, as its main object, the goal to study how the evolutive interpretation technique is being used by the Inter-American System of Human Rights. The aim was to demonstrate, firstly, that human rights, due to their special nature, do allow a dynamic interpretation in order to achieve their implementation. Afterwards, it was sought to analyze how this technique has been used in the interpretation of the American Convention on Human Rights and its importance for the construction of the inter-American corpus iuris. Finally, in order to demonstrate how this hermeneutic activity takes place, the study analyzes some of the cases judged by the Inter-American Court of Human Rights in which the evolutionary interpretation was used.
