The decision and grounds of the Federal Supreme Court's decision in the Argument for Non-Compliance with Fundamental Precept No. 734, which addressed freedom of expression and its extension to civilian public security agents, are examined.
Using an analytical-reconstructive methodology, the fundamental bases of legal and meta-legal arguments are identified. The conclusion is that the Federal Supreme Court could have dealt in greater depth with the possibility of harmonizing, as far as possible, the fundamental right to freedom of expression with the restrictions specific to civil police careers.
