Dignifying work as a fundamental human right: Brazil before the IACHR in Case 12.066

The starting point of this work is the premise that the dignifying work in dignifying conditions is a powerful social and economic instrument of implementation of income distribution and social equality. Given this established premise, this study uses literature and legislation review to bring a brief analysis of the legal issue of slave work in Brazil and of the inclusion of the dignifying work as a fundamental principle of the 1988 Brazilian Constitution, followed by the approach on the accession of the Country to the Inter-American Human Rights System, to study the complaint and the merit report on slave labor in Brasil Verde Farm in Pará, before the Inter-American Commission on Human Rights (IACHR), which led to Case 12.066 before the Inter-American Court of Human Rights (IDH Court). The conclusion of this research points to the fact that the absence of social reintegration is a factor that contributes to the difficulty of effective restoration of the violated rights.
