A Constituição Austeritária

O presente trabalho examina como se tem desenvolvido um “novo” constitucionalismo centrado mais no controle fiscal do Estado do que no sistema de direitos fundamentais. As instituições da “velha” simbologia constitucional foram substituídas ou complementadas por outras que mais se adequam a esse “novo” constitucionalismo, baseado na busca da eficiência econômica como legitimação em detrimento do processo democrático como legitimidade. Esse “projeto de significação” constitucional é, ao fim, uma rendição jurídico-política à lógica econômica, tendo como bandeira de triunfo a “Constituição austeritária”, com a centralidade movida dos direitos para o “Estado fiscal” e “autoritário”, e como substratos determinantes as demandas do capitalismo financeirizado.
