Courts and social change: the use of courts to advance significant social reforms

The use of litigation as a strategy to advance social change has prompted a diverse range of academic production over the past decades. The debate on what is conventionally called "courts and social change" involves a wide range of issues from the separation of powers and judicial activism to the analysis of the effects of litigation and the diagnosis of which conditions favour or mitigate the implementation of sentences. This article reviews the main reflections on the role of the courts in the production of social change, seeking to reconstruct the progress of the debate and present its current configuration. To this end, it addresses the reasons that led the search for change to the courts, the related democratic issues and two different approaches to the study of these types of litigation. Finally, the current terms of the debate are presented. The conclusion of the article argues for the importance of the study on courts and social transformations considering not only the permanence of the theme in academic production, but especially the continuity of litigation in this sense around the world.
